I think you'll find that while the requirement for approved equipment
has been removed from statute law, Telecom's terms of service say quite
explictly that only approved equipment may be attached to their network.

I doubt that Telecom are alone in this.

As such, while the Telecommunications Act bullshit is probably just
trying to sound heavy handed, it's still illegal to attach unapproved
equipment to Telecom's network. It's just that it's a civil matter, not
a criminal one.
